How Elon Musk’s Legal Shift In OpenAI Case Is ‘Confusing’

American tech firm OpenAI has accused Elon Musk of changing his legal stance at the last moment, in the legal dispute between the company and the tech mogul, calling the move a ‘legal ambush’ just weeks before the trial takes place in April. In a recent court filing, the Sam Altman-led company stated that the Tesla CEO’s new demands seem to be designed to ‘inject chaos into the proceedings’ and reshape the perception of the public about his case rather than support one consistent legal argument, reported Bloomberg.
Legal Dispute Between Elon Musk And OpenAI
The trial between OpenAI and Elon Musk is scheduled for April 27. The xAI chief filed a lawsuit against Microsoft and OpenAI in 2024, asserting that OpenAI has shifted away from its original mission of being a nonprofit research-focused organisation. He stressed that the AI firm shifted direction after it received billions of investment from Microsoft and started transitioning toward a for-profit company.
Microsoft and OpenAI maintain their stance about not being involved in any wrongdoing that their actions are lawful and consistent with the company’s growth. Previously, Musk urged the court that he wanted to seek between $79 billion and $134 billion as damages, suggesting he deserves compensation tied to OpenAI’s big investment in value since its early days. However, Musk has shifted his stance, as per the report. He is now asking the court that any financial award should be directly returned to OpenAI, and not to him.

Elon Musk Changes His Legal Stance
The legal team of Musk proposed major changes in the financial decisions of OpenAI and requested structural changes, including the top leadership changes at the San Francisco-based company. OpenAI has rejected the new proposals from Musk and called them “legally improper and factually unsupported.” Moreover, the AI firm argued that Musk’s revised claims will need new proof and witnesses.
